1. Agreement to Terms

By accessing or using Sntmnts! ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Virtual Currency (sntmnts)

The virtual currency used on this platform ("sntmnts") is:

• Exclusive to this platform - Sntmnts have no value outside of the Sntmnts! platform and cannot be exchanged for real money, cryptocurrency, or any other form of value or consideration.
• For entertainment purposes only - All trading, investing, and transactions using sntmnts are simulated activities for fun and analytical purposes.
• Non-transferable - Sntmnts cannot be transferred to other users, sold, or exchanged outside of platform mechanics.
• Subject to reset - We reserve the right to reset, modify, or remove sntmnt balances at any time, particularly during the transition from Version 0 to Version 1.

3. Not Financial or Investment Advice

Nothing on this platform constitutes financial advice, investment advice, trading advice, or any other sort of professional advice. The "sentiment trading" on Sntmnts! is a game-like simulation and should not be used to make real-world financial decisions. We are not a licensed financial advisor, broker, or dealer.

4. Third-Party Intellectual Property

Users may create "sentiment cards" featuring names of public figures, brands, companies, events, or other topics. Regarding this content:

• No ownership claimed - Sntmnts! does not claim ownership of any trademarks, copyrights, or other intellectual property rights belonging to third parties. All such names, brands, and marks remain the property of their respective owners.
• Entertainment purpose - The use of third-party names and brands is solely for entertainment, commentary, and analytical purposes within the context of sentiment expression.
• Right to removal - Any individual, company, or rights holder who believes their intellectual property rights are being infringed may request removal of the relevant content. We will process such requests in accordance with applicable law.
• No endorsement - The presence of any name, brand, or entity on our platform does not imply any endorsement, sponsorship, or affiliation with Sntmnts!.

5. Content Removal Requests

If you are a rights holder and believe that content on Sntmnts! infringes your intellectual property rights, please contact us at info@sntmnts.com with:

• Identification of the copyrighted work or trademark claimed to be infringed
• Identification of the material on our platform that you claim is infringing
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in the notice is accurate
• Your physical or electronic signature

We will review all valid requests and take appropriate action, which may include removing the content in question.

6. User Conduct

You agree not to:

• Create content that is defamatory, obscene, harassing, or promotes hatred
• Impersonate any person or entity
• Use the platform for any illegal purpose
• Attempt to manipulate the platform, exploit bugs, or use automated systems to gain unfair advantages
• Interfere with or disrupt the platform or servers
• Create multiple accounts to circumvent rules or gain additional starting currency

7. Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the platform ceases immediately, and any accumulated sntmnts will be forfeited.

8. Version 0 Performance Rewards

Users who demonstrate exceptional performance during Version 0 may receive credits, recognition, or other benefits when Version 1 launches. However, this is at our sole discretion, and we make no guarantees regarding the nature, value, or availability of any such rewards. Performance metrics and reward criteria may change without notice.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNTMNTS! AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless Sntmnts! and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration or in courts of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the platform. Your continued use of the platform after such modifications constitutes your acceptance of the updated Terms.

14. Age Requirement

You must be at least 13 years old to use Sntmnts!. If you are under 18, you represent that you have your parent or guardian's permission to use the platform.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sntmnts! regarding your use of the platform and supersede all prior agreements and understandings.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Sntmnts!.

18. Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SNTMNTS LLC AGREE THAT ANY DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

If this class action waiver is found to be unenforceable, then the entirety of the arbitration agreement shall be null and void.

19. Force Majeure

Sntmnts! shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, materials, or telecommunications or internet failures or delays.

20. Third-Party Links and Content

The platform may contain links to third-party websites, services, or content that are not owned or controlled by Sntmnts!. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Sntmnts! shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

21. Sponsored Content and Commercial Partners

Sntmnts! may display sponsored content, including but not limited to sentiment cards or tickers that are created or promoted by commercial partners. Such sponsored content will be identified where required by law, but users acknowledge that commercial relationships may exist between Sntmnts! and entities represented in sentiment cards.

The presence of sponsored content does not constitute an endorsement, guarantee, or recommendation by Sntmnts!. Users should exercise their own judgment when interacting with any content on the platform.

22. Embeddable Widgets and Third-Party Integration

Sntmnts! may offer embeddable widgets or integrations that allow our sentiment cards to be displayed on third-party websites. When you encounter Sntmnts! content on third-party sites:

• The third-party website is solely responsible for its own content, privacy practices, and terms of use.
• Sntmnts! is not responsible for how third parties implement, display, or use our widgets.
• Your interactions with Sntmnts! widgets on third-party sites remain subject to these Terms.
• We make no warranties regarding the availability, accuracy, or functionality of widgets on third-party sites.

Third-party website operators who embed Sntmnts! widgets do so at their own risk and are responsible for ensuring compliance with applicable laws and regulations in their jurisdictions.

23. Service Availability

Sntmnts! does not guarantee that the platform will be available at all times or that access will be uninterrupted. We may suspend, withdraw, discontinue, or change all or any part of the platform without notice. We will not be liable to you if for any reason the platform is unavailable at any time or for any period.
